1. Purpose
   PetSoul Gallery is an online store specializing in the creation of personalized pet portraits.
   Customers can choose from over 150 unique artistic styles (Sports, Historical, Jobs, Lifestyle) to express their pet’s unique personality.
   These Terms and Conditions define the rights and obligations between:
   • PetSoul Gallery, a registered trademark and e-commerce service operated by the company based in the Dominican Republic under the name 26 Caribbean SRL 
   • And any individual or legal entity (hereinafter referred to as “the Client”) making a purchase on the website petsoulgallery.com.
     The products sold are exclusively personalized digital pet portraits, created from photos provided by the Client and generated using artificial intelligence tools under artistic direction.
2. Acceptance of the Terms
   1. By confirming an order, the Client fully and unreservedly accepts these Terms and Conditions.
   2.2. If the Client does not accept these conditions, they must not proceed with the purchase.
3. Registration and Client Account
   1. The Client must create a personal account during their first order, providing accurate and up-to-date information.
   3.2. The Client is solely responsible for the confidentiality and use of their login credentials.
   3.3. In the event of unauthorized access to their account, the Client agrees to immediately notify PetSoul Gallery.
4. Products – Nature and Delivery
   1. All products are digital files delivered by email, download link, or directly to the Client’s account on www.petsoulgallery.com.
   4.2. The portraits are generated using a licensed commercial AI, directed by PetSoul Gallery’s artistic team, from a photo (real or not) of the pet uploaded by the Client on the website www.petsoulgallery.com. As the images are AI-generated, PetSoul Gallery cannot guarantee that the generated portraits created for the Client will be 100% identical to the reference portraits displayed on the site and selected by the Client. The artistic team will do its best to match the original examples. The generated portraits should be understood as representing a style or spirit, and not an exact replica of the samples presented on the PetSoul Gallery website.
   While our creations are highly accurate, slight differences may appear in the final result. Rest assured that we thoroughly review and check each portrait before sending it to you.
   4.3. Files are delivered in compressed ZIP format, in high resolution (approximately 8192×12188 pixels).
   4.4. It is the Client’s responsibility to unzip the files in order to use them.
   4.5. No physical shipping of products is provided.
   4.6. Delivery time is 48 business hours after payment confirmation. This time frame is indicative and may vary in case of overload or force majeure.
   4.7. To avoid overloading PetSoul Gallery servers, delivered files will remain available in the Client’s account for download for a maximum of 30 days from the date of the notification email. After this period, files will be deleted.
   4.8. However, upon the Client’s express request to hello@petsoulgallery.com, a copy of the files may be sent by email within a reasonable timeframe.
5. Order Process
   • Steps:
     Selection of 1 style from the available options (over 150 styles offered);
     • How to personalize your desired portrait? In the final step of your order, you will be asked to upload a photo of your companion.
      o If you upload a photo (max 2MB – JPG, JPEG, PNG), our artists will use it to best adapt the chosen style. The better the quality of the photo, the better the result. A front-facing image is preferred. The more visible your pet is, the more spectacular the outcome.
      o If no photo is provided, you will receive a non-personalized portrait of the animal as presented on the website.
   • The Client may choose the desired format but not the resolution. At checkout, for each portrait, the Client can choose between:
     Square format (1:1)
     • Portrait (vertical) format (2:3)
     • Landscape (horizontal) format (3:2)
   • • PetSoul Gallery declines any responsibility for unsatisfactory results due to poor photo quality.
6. Payment confirmation: Once payment is confirmed, the order is considered final and irrevocable.
   The Client will receive an email containing a link to access their client account and a personalized password.
   • The password is strictly personal. The Client is fully responsible for its protection.
7. The Client guarantees:
   That they are the rightful owner of the uploaded photo or are duly authorized to use them;
   • That they possess the necessary rights for their use for personalization purposes. The client cannot request the addition of a logo, brand, or branding in the creation of portraits. Indeed, for copyright reasons that PetSoul Gallery cannot verify, the import of such images or files is not authorized and will not be considered under any circumstances by PetSoul Gallery.
   • That they expressly release PetSoul Gallery from any liability in case of third-party rights infringement (copyrights, image rights, etc.). The Client agrees to indemnify PetSoul Gallery in the event of any claim or legal action related to the submitted photos. PetSoul Gallery reserves the right to refuse any order that does not comply with these criteria.
8. Price – Payment – Invoicing
   • The price per product is listed on the website petsoulgallery.com and may be modified without prior notice.
   • All our prices are expressed in United States Dollars.
     • Secure payment is processed via a third-party platform. Before ordering and paying on these platforms, the customer must check the conditions of use and security of these platforms. Under no circumstances can PetSoul Gallery be held responsible for the loss or fraudulent use of customer data, including bank card details, access codes, passwords, etc.
       Orders are processed only after successful payment confirmation.
     • The Client will receive an invoice after delivery and payment; it will also be available in their client account.
9. Right of Use of the Works
   • Delivered portraits are intended strictly for personal, artistic, or decorative use.
   • It is strictly prohibited without written and/or commercial agreement to:
     use them for commercial or advertising purposes;
     • resell, reproduce, or distribute them;
     • use them on professional media (website, packaging, campaign, etc.).

10. Special Orders:
    For any special orders, please contact the sales department by writing to hello@petsoulgallery.com.
    A personalized quote will be sent. Once approved, the customer must place their order under the same conditions as described above. If specific elements are required in the creations, the customer must provide proof of use or ownership (proof of registration). Furthermore, the customer:
    • agrees to use the generated image exclusively in a strictly private and non-public setting.
    • is prohibited from distributing the image in a professional or promotional context (even within a company or association);
    • is prohibited from selling, offering, or exploiting the image for commercial or public purposes;
    • is prohibited from using the image as a communication, advertising, or brand visual;
    • releases PetSoul Gallery from any liability in the event of legal action, complaint, or damage resulting from such use;
    • assumes full responsibility for any subsequent use of these protected elements and agrees to indemnify PetSoul Gallery for any claims, actions, or proceedings resulting from unauthorized use.

    PetSoul Gallery reserves the right to refuse any order containing protected elements if it considers such use to be incompatible with intellectual property laws.
    Similarly, no defamatory, racist, or sexually explicit representations will be accepted. PetSoul Gallery reserves the right to refuse any non-compliant order at its sole discretion, without having to provide a reason to the customer.
    No real person, brand, celebrity, or protected content may be depicted.

11. Ownership of the Generated Images The portraits are generated using a licensed commercial AI, based on a real or non-real photo of the animal, under the artistic direction of the PetSoul Gallery team.
    • They are royalty-free for private use only.
    • PetSoul Gallery reserves the right to cancel a Client’s order if these clauses are violated. In such cases, the order will be refunded to the Client.
12. Right of Withdrawal – Cancellation
    • In accordance with Dominican legislation, no right of withdrawal applies to personalized digital goods.
    • No refund may be claimed once the order has been confirmed.
13. Liability
    PetSoul Gallery shall not be held liable for:
    any misuse or illegal distribution of the artworks;
    • any unauthorized commercial use;
    • any dispute related to elements provided or requested by the Client;
    • any loss or alteration of the files after delivery.
14. Force Majeure: Suspension of obligations in the event of circumstances beyond the control of PetSoul Gallery. Any circumstance beyond the control of the parties, preventing the fulfillment of their obligations under normal conditions, shall be considered a ground for exemption and will result in suspension of those obligations. The party invoking such circumstances must immediately notify the other party of their occurrence and later of their resolution.

Force majeure” refers to any irresistible, external, unforeseeable, and unavoidable event or circumstance beyond the control of the parties that cannot be prevented despite all reasonable efforts. Events expressly considered as force majeure or fortuitous events, in addition to those typically recognized under Dominican jurisprudence, include: transport or supply blockages, earthquakes, fires, storms, floods, lightning, telecommunications network outages, or difficulties related to telecommunications networks beyond the PetSoul Gallery’s control.

16. Use of Images on Third-Party Services (Print-on-Demand, etc.)
    • PetSoul Gallery may, for informational purposes, present on its website or in its communications suggestions for using digital portraits via third-party print-on-demand services.
    • The Client remains entirely free to choose the provider or technical solution of their choice for personal use of their image.
    • PetSoul Gallery is in no way responsible for the operation, terms of sale, or privacy policies of these platforms. The Client is solely responsible for reviewing and understanding the terms of use, sales conditions, and data handling policies offered by such third-party services before placing an order with them
    • Although PetSoul Gallery may receive revenue or commissions through potential commercial partnerships or affiliate programs with certain providers, the Client is under no obligation to use these services.
    • PetSoul Gallery provides this information solely to enhance the user experience, without any commitment or guarantee regarding the quality, delivery times, or results of the services provided by such companies.
    • Consequently, PetSoul Gallery disclaims all liability in the event of disputes, service failures, complaints, or damages resulting from the use of delivered images on these platforms or any other third-party service.
17. Personal Data Protection
    • PetSoul Gallery collects and processes Client data in accordance with its privacy policy and Dominican regulations (Law No. 172-13 on data protection).
    • The Client may exercise their rights of access, rectification, or deletion by writing to: hello@petsoulgallery.com.
18. Website
    • We strive to ensure that the information available on this website is kept up to date at all times. However, we cannot guarantee uninterrupted service and disclaim all liability for any errors or omissions. We make every effort to correct errors or omissions as soon as they are identified or reported. We also reserve the right to modify, suspend, or remove any part of the website, including features, information, databases, or content, or to restrict access to any part or all of the website, without notice and without liability. You acknowledge that this does not create any liability toward you or any third party.
    • We may also modify these Terms and Conditions at any time, and continued use of the site constitutes acceptance of such modifications. It is your responsibility to regularly check whether the Terms and Conditions have been updated.
    • It is prohibited to use this website for the following purposes:
      to distribute illegal, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable content;
      • to transmit content that incites conduct constituting a criminal offense, harms minors, or results in civil liability;
      • to violate any applicable law, regulation, or code;
      • to unlawfully access other computers or systems;

      • the price or the method of calculating the price;
      • the delivery timeframe;
      • the identity of the seller, their contact details, and their activities;
      • the legal warranties and functionalities of the digital content;
      • the terms of execution of the warranties and other contractual conditions.
19. Disclaimer
    THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT ANY WARRANTY. THE COMPANY DISCLAIMS ALL EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL MEET THE USER’S REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, OR BE FREE FROM VIRUSES OR OTHER HARMFUL ELEMENTS. IF THE APPLICATION OR SERVICES ARE DEFECTIVE, THE COMPANY IS NOT RESPONSIBLE FOR THE COSTS OF REPAIRING OR REPLACING DATA OR EQUIPMENT. THE COMPANY MAKES NO GUARANTEE AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICES.
20. Data Transmission Disclaimer
    The transmission of data (including via email) over the internet is not secure and may be subject to loss, interception, or alteration. Therefore, the Company disclaims all liability for any damage or cost related to such transmission.
    Transmitted data is not considered confidential, and the Company assumes no responsibility in the event of disclosure or access by unauthorized third parties.
    The Company is not responsible for data uploaded to the services, nor for its deletion, alteration, or loss, or for the absence of backup. Users are responsible for maintaining their own backup copies.To the extent permitted by law, neither the Company nor its affiliates, officers, employees, or partners shall be liable for any direct, indirect, special, punitive, exemplary, or consequential damages related to the use of or inability to use the services, even if informed of the possibility of such damages. The Company’s maximum liability shall not exceed the amount paid for the services.
21. Indemnification
    Users agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, agents, and partners from any claim, loss, liability, or expense (including legal fees) arising from: (i) use of the services; (ii) user-generated content; (iii) breach of these Terms and Conditions.
    The Company will notify the user of any claim and assist in the defense at the user’s expense. The Company reserves the right to take over the defense if it chooses.
22. Governing Law and Disputes
    • These Terms and Conditions are governed by the laws of the Dominican Republic.
    • In the event of a dispute, the parties agree to seek an amicable resolution.
    • If no agreement is reached, the dispute shall fall under the exclusive jurisdiction of the competent courts of the Dominican Republic.
    • The Client may also refer the matter to a mediator or the Dominican Consumer Protection Agency.
23. Modifications
    • These Terms and Conditions apply from the date of their publication on the Website.
    • PetSoul Gallery reserves the right to modify these Terms and Conditions at any time; any changes will be published along with the update date.
